Step 1 : Read the License Agreement
Before purchasing this software, you must agree to adhere to the license agreement.
Please read the license agreement below complete and carefully.
GENERAL COPYRIGHT NOTICE (2005-01-23) The software 'openCI' is a copyrighted work. We retain ownership of the software and any copies of it, regardless of the form in which the copies may exist. By purchasing and/or using openCI on your server or webspace, you agree to the following terms and conditions. This agreement is either on your own behalf or on behalf of any company which you represent. In this Agreement, 'you' includes both the reader and in case the company which employs you. In this Agreement, 'openCI' means the current copyright holder of the software openCI. and ' the Software' means the software openCI as distributed. An openCI license grants you the right to run a single installation of the software on one web server and one web site for each license purchased. Each license may be used to run one instance of the Software on one domain. For each installed instance of the Software, a separate license is required. Modifications to the Software or database to circumvent the rule above are prohibited. You are not allowed to modify the Software in any way which would enable you to provide or run multiple instances, hosting services or functions of the Software. In detail that means that you are not allowed to run the software in any way which may prevent anyone from the need of purchasing a license of the Software in order to use it. The Software is licensed only to you. You may not rent, lease, sub-license, sell, transfer, assign, pledge or otherwise dispose of the Software in any form, on a temporary or permanent basis, without the prior written consent of openCI. The license is effective until terminated (perpetual license) The license is effective for one year from the date you activate the Software (one-year license). You have to ensure that, prior to use of the Software by your employees or agents, all such parties are notified of the terms of this Agreement; and hold all data (including object and source codes), software listings and all other information relating to the Software confidential and not at any time, during the period of the license or after its expiry, disclose the same whether directly or indirectly to any third party without openCI's consent. After the expiry of the 'one-year license', the Software must either be removed from the server, or another license purchased. You have to submit the URL where you are using (or plan to use) each license. All openCI.de copyright notices contained therein must remain unchanged and visible on all web pages. Link (Powder by ....) notices must not be removed or altered under any circumstances without the express permission of openCI.de. This scripts is owned by openCI.de and is protected by national copyright laws and international copyright treaties. Authorization to remove or modify output of copyright notices can be obtained from openCI for a fee. This fee authorizes you to remove the output of copyright notices: it does not give you authorization to remove any copyright notices in the program source files or any other rights. You may not sell or distribute the code of scripts in whole or part. You may not sell templates made for the Software without the permission of openCI. In general you may not earn money with the Software or services provided for the software without our permission. The Software may not be used for anything that would represent or is associated with an intellectual property violation, including, but not limited to, engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. If any of the terms of this Agreement are violated, openCI reserves the right to revoke the license at any time. On termination, you must destroy all copies of the Software within 72 hours. Refunds will not be given. DISCLAIMER OF WARRANTY The Software is sold on an " As Is " basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement. openCI is not liable for the content of any webpage powered by the Software. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective, you and not openCI assume the entire cost of any service and repair. In addition, the security mechanisms implemented by the Software have inherent limitations, and you must determine that the Software sufficiently meets your requirements. This disclaimer of warranty constitutes an essential part of the Agreement. You must assume the entire risk of using the program. ANY LIABILITY OF OPENCI WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. In no event will openCI be liable to you for any damages, including any lost profits, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the use of or inability to use such Software, even if openCI has been advised of the possibility of such damages. Nothing in this Agreement limits liability for fraudulent misrepresentation. MISCELLANEOUS By purchasing the Software you made sure that you can use it in the way it is mentioned. Your webserver has to achieve some requirements we have no stake in. You will NOT get refunds if you are not able to install the Software cause your webserver lacks in requirements. Technical support will not be provided for third-party modifications to the Software including modifications to code, Skin packs, and Language packs to any license holder. If the Software is modified using a third-party modification instruction or otherwise, technical support may be refused to any license holder. openCI reserves the right to publish a selected list of users of the Software. By installing the Software and from time to time, openCI may inspect your registration integrity. This will be done without collecting any information whatsoever about your server or your users. The only information verified will be your license number and the domain on which the software is run. Should openCI discover discrepancies in the software usage, be aware that you may lose your license and may face legal actions for Software Piracy. Your information will not be shared with 3rd parties. PREODER AND BETA VERSION With your preorder you buy a full valid license to use openCI as soon as it is released. Your benefit is that you pay EUR 20 less. If you preorder an ‚one-year license' the release date of the first public non beta version of the Software is the date your ‚one-year license' starts to count down. You also purchase the privilege to beta test the current beta version of the Software and future ones up to openCI 1.0 final. You are not allowed to use the beta version in any way other then testing it. Particularly with regard to the copyrights you are not allowed to redistribute it in any way. Please also note that the possibility of security related software errors is in general very high in a beta version. The usage is carried out at your own risk! Their is NO warrenty of any kind for the beta versions. Their is also NO guarantee that you will be able to run the beta version of the Software at your webserver. Refunds are debarred ! You purchase the final version of openCI which is not released yet. The possibility to beta test is just a bonus FORUM RULES By purchasing this software you also agree to the forum rules below. A forum account is needed to download your purchased copy of openCI. Registration to the forum is free! We do insist that you abide by the rules and policies detailed below. Although the administrators and moderators of openCI Community Forum will attempt to keep all objectionable messages off this forum, it is impossible for us to review all messages. All messages express the views of the author, and neither the owners of openCI Community Forum, nor Jelsoft Enterprises Ltd. (developers of vBulletin) will be held responsible for the content of any message. By agreeing to these rules, you warrant that you will not post any messages that are obscene, vulgar, sexually-orientated, hateful, threatening, or otherwise violative of any laws. openCI reserves the right to remove, edit, move or close any thread for any reason. openCI reserves the right to ban, remove or delete any user for any reason. GENERAL openCI reserves the right to modify the terms of this Agreement at any time. Changes to the Agreement will be announced via email. Failure to receive notification of a change does not make those changes invalid. A current copy of this Agreement is available on openCI web site. If any part of the above limitations or exclusions is held to be void of unenforceable, such part shall be deemed to be deleted from this agreement and the remainder of the limitation or exclusion shall continue in full force and effect GOVERNING LAW This Agreement shall be governed by the Laws of Berlin / Germany. Any action in regard to this Agreement or arising out of its terms and conditions shall be instituted and litigated in the Circuit Court of Appomattox County. Each of the parties consents to jurisdiction in such Court and agrees that service of process as provided by the states and rules of civil procedures of Berlin / Germany shall be sufficient.
